Status Update of Appellate Court Decision: School Mask Mandate 1/28
Earlier this week, the Appellate Division, Second Department issued a stay order which upheld the Department of Health’s mask requirement in schools (10 NYCRR 2.60). Although the court set a hearing deadline for today, the State Education Department has confirmed that this deadline pertained only to written submissions. SED anticipates that the court will issue a further ruling in the coming weeks. Until such time, the mask rule remains in effect.

Update: Mask Mandate Temporarily Stayed - Masks Will be Required on Wednesday, 1/26
We have just received word that the Appellate Division granted the application by the Department of Health and the Governor’s office, confirming that the lower court’s decision is temporarily stayed pending further proceedings which are scheduled for Friday.

NY State Supreme Court Ruling Regarding Mask Mandate
We are aware of the latest news regarding the Supreme Court Decision and the mask mandate. Currently, we are awaiting official notification from the Governor’s office, as well as from our attorneys, on what we will be able to do. Right now, we have no authority to remove the mask mandate and expect all students and staff to continue to wear masks while in our schools.
